3. Eligibility and Accounts
You must be at least 18 years old and able to form a binding contract to use the Service. You agree to provide accurate information when creating an account and to keep your account credentials secure. You are responsible for all activity under your account.
4. User Responsibilities
- Obtain all necessary patient consents before uploading any image, video, or identifiable information
- Use the Service in compliance with all applicable laws and regulations
- Not upload content that is unlawful, infringing, harmful, or that violates the rights of any third party
- Not attempt to reverse engineer, scrape, or interfere with the Service or its underlying infrastructure
- Not use the Service to make medical diagnoses or replace clinical judgment
5. Payment and Subscriptions
Paid plans are billed in advance on a recurring basis (monthly or annually) at the rates posted on our website. By subscribing, you authorize us to charge your payment method on each renewal date. Unless otherwise required by law, payments are non-refundable. You may cancel at any time; cancellation takes effect at the end of the current billing period.
We may change pricing with at least thirty (30) days' prior notice. Continued use of a paid plan after a price change constitutes acceptance of the new pricing.
6. Intellectual Property
All software, models, designs, trademarks, and content provided by Dental Vision are owned by HP DIGITAL or its licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms.
You retain ownership of the content you upload. You grant us a limited license to process that content solely to provide the Service to you.
7. AI-Generated Content
Smile simulations generated by the Service are illustrative previews based on machine learning models. They are not clinical predictions and may differ from actual treatment results. You are solely responsible for how you present and interpret simulations with patients.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, DENTAL VISION AND HP DIGITAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
10. Indemnification
You agree to indemnify and hold harmless Dental Vision, HP DIGITAL, and their affiliates from any claims, damages, or expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party, including patients.
11. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, if you breach these Terms or engage in conduct that we believe is harmful to the Service or its users. You may terminate your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction in such courts.
